By accessing or using the CycleSpire AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

CycleSpire AI provides an enterprise AI agent orchestration and lifecycle governance platform. The Service includes AI-driven development tools, automated operations, data lifecycle management, and related features as described on our website.

3. Account Registration

To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service

5. Intellectual Property

The Service and its original content, features, and functionality are owned by CycleSpire AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your use of the Service does not grant you ownership of any content, code, data, or materials you may access.

6. Your Data

You retain ownership of all data you submit to the Service ("Your Data"). By using the Service, you grant CycleSpire AI a limited license to process Your Data solely for the purpose of providing and improving the Service. We will not use Your Data to train AI models shared with other customers without your explicit consent.

7. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

8. Service Level Agreement

Enterprise customers are covered by our SLA, which guarantees 99.9% uptime for production services. Details of the SLA, including remedies for downtime, are provided in your enterprise agreement.

9. Limitation of Liability

To the maximum extent permitted by law, CycleSpire AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may export Your Data within 30 days of termination. After 30 days, we may delete Your Data.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
